The Competition Council carried out an unannounced inspection at the premises of Sun Wave Pharma SRL, a company active on the food supplement distribution market. The inspection took place as part of the in-depth investigation aimed at the possible violation of the rules on unfair competition by Sun Wave Pharma, which allegedly exerted pressure on the manufacturer Geltec Private Ltd. to stop supplying food supplements to Bleu Pharma SRL, its competitor on the market national.
“In this new case targeting actions of unfair competition, we are looking at the conditioning of commercial transactions between partners, which goes against fair practices and, at the same time, destabilizes the activity of smaller players in the market,” said Bogdan Chirițoiu, the president of the Council Competition.
The analysis was triggered as a result of the notification made by Bleu Pharma SRL. The unannounced inspections are authorized by the Bucharest Court of Appeal and are justified by the need to obtain all the information and documents necessary to clarify the possible practice of unfair competition.
Carrying out inspections does not prejudge the competition authority regarding the company’s guilt. In the situation where the Competition Council finds a violation of the rules of fair competition, the authority orders measures to prohibit the commission of the act and issues a decision on the basis of which the court can decide compensation for the Bleu Pharma SRL company.
