Constitutional Court’s reasoning on Pension Law: Improper language, unclear, inaccurate

The Constitutional Court has released the reasoning for declaring unconstitutional two articles of the Pension law, mentioning that the law was poorly written and is unclear. The lawmaker should have been more rigorous when defining who are the taxpayers to the public pension system and who is to pay the social security contribution.

“The lawmaker should have considered the regulations which are a landmark in terms of clarity, whereas the errors in appreciation when editing the normative acts should not perpetuate, meaning that they become themselves a precedent in the enactment activity,” the Constitutional Court judges say.

The Constitutional Court ruled in March that the Pension Law is partially unconstitutional, following the referral from PNL and USR on several provisions of the bill.
