President Klaus Iohannis has refused to promulgate the law on the local elected having the right to be part of the companies’ general assemblies, one of the most common incompatibilities. The draft law was voted on October 4 and was criticized by the National Integrity Agency (ANI), hotnews.ro informs.
The head of state is the most famous case of such incompatibility. In January 2015 the High Court for Cassation and Justice (ICCJ – Supreme Court) decided that the former Sibiu Mayor Klaus Iohannis was not in an incompatibility case. The judges rejected as unfounded the ANI appeal and upheld the decision on September 2013 by the Alba Iulia Court of Appeal ruling Iohannis was not in an incompatibility case.
In April 2013 Klaus Iohannis was declared as being in incompatibility by ANI because he had held simultaneously the position of Sibiu mayor and the municipality’s representative to the shareholders general assembly of SC Apa Canal SA and SC Piete SA.
