PNL notifies the Ombudsman to challenge to CCR the charging of part-time contracts

PNL Chairman Ludovic Orban has notified on Wednesday the Ombudsman, asking him to challenge to the Constitutional Court (CCR) the charging of part-time contracts, stating that he had discussed with the representatives of the institution and that he had the guarantee that the Ombudsman would go ahead with the PNL request.

“Today we have filed a petition to the Ombudsman to determine the institution to invoke an objection of unconstitutionality in respect of Ordinance 4 on the payment of social security contributions for health and pension at the level of the guaranteed minimum wage for those working part-time and in accord,” Ludovic Orban said.

Orban added the Liberals believe that several articles of the Romanian Constitution and the Tax Code have been violated.

Ludovic Orban said that he no longer believes any Social-Democratic Party official statement in relation to taxes and duties and requested that the Social Democrats remove from the governing programme all fiscal “aberrations”.

“I no longer believe any statement of any PSD official related to taxes and duties. I request once again that they come in front of Parliament and discard from the governing programme all the fiscal aberrations that they introduced when Tudose’s Government was sworn in office. It is unbelievable what is going on,” Ludovic Orban said when quizzed about premier Mihai Tudose’s statement as to the solidarity tax being abandoned.

In relation to the budget deficit, the PNL leader said that based on the data registered in the first six months of the year, “the governing party should go home, perform a seppuku.”

On Monday, the PNL chairman announced the party Executive Committee decided to notify the Ombudsman in order to challenge the above mentioned government ordinance.

“We believe that, by adopting this ordinance, the Constitution was violated in several issues. We know organic laws cannot be amended by simple ordinances and the Tax Code is an organic law. Furthermore, the Tax Code itself was violated – it reads that any tax and constitution amendment should come into force as of January 1 and to be in force at least one year. This is what the Tax Code reads, they have amended the code without amending this very provision,” Ludovic Orban said at the time.

Orban added the simple ordinance also violates an article in the Constitution stating that the contributions should be fair, however the liberals believe that paying the CAS and CASS at the same level as the full-time employees is a different issue.
