Bucharest Court of Appeal has declined jurisdiction to the Bucharest Tribunal to solve the DIICOT’s request to re-open investigation against the former Gendarmerie chiefs in the August 10 rally file.
After anti-organized crime prosecutors had partially dismissed the August 10 case in mid-July this year, DIICOT has announced few days ago that they had re-opened the criminal prosecution against the former Gendarmerie chiefs during the Diaspora rally on August 10, 2018.
The Bucharest Court of Appeal had delayed a ruling in the Diaspora rally case.
So, if the magistrates start rejudging the case, Colonel Gheorghe Sebastian Cucoş, first deputy chief of the Romanian Gendarmerie, major Laurenţiu Cazan, former director general of the Bucharest Gendarmerie, colonel Cătălin Sindile, former chief of the Romanian Gendarmerie will be further investigated for abusive conduct, aiding and abetting in intellectual forgery, complicity to abuse of office.
In the ordinance of reopening of the investigation, the DIICOT chief Giorgiana Hossu explained that the case prosecutor, Doru Stoica, the one who dismissed the charges against the former gendarmerie chiefs, had not re-administered the evidence collected by the Military Prosecutor’s Office in the August 10 file and had neither heard again the suspects, victims and witnesses.
Giorgiana Hosu also argued that the former gendarmerie chiefs had refused to make statements when they had been summoned to the Military Prosecutor’s Office, but they should have been subpoenaed at DIICOT after the file had been taken over by the military prosecutors.
At the same time, no injured party or eyewitness have been subpoenaed to DIICOT, except for some officials, such as the former Interior Minister Carmen Dan, ex-Bucharest prefect Speranta Cliseru, and Bucharest deputy mayor Aurelian Badulescu, who were in charge back in August 2018 during the Diaspora protest.
