Călin Georgescu Loses Final Appeal in the Presidential Election Annulment Case

The Supreme Court of Justice rejected the appeal filed by Călin Georgescu in the presidential election annulment file. The High Court of Cassation and Justice (ÎCCJ) resumed today the debates in the case of the appeal filed by Călin Georgescu in the presidential election annulment case. The appeal made to the supreme court comes after the Court of Appeal rejected the request made by the independent candidate in the Romanian Presidential elections.

Călin Georgescu announced on Thursday, after almost six hours of deliberations at the ÎCCJ, that the supreme court remains in deliberation and “probably tomorrow (Friday, January 17, editor’s note) we will know the result”.

“Nobody wants to be in the shoes of the president of the court today, honestly, I tell you. I mean, there is undeniable evidence of fraud and illegality and unconstitutionality, and on the other hand, there is no evidence, as you all know and the entire Romanian people know and in fact we are on all sides at this moment, the decision was not only abusive and the fact that it is proven that they had no evidence, including former president Klaus Iohannis or citizen Klaus Iohannis, as I should say now, at his last public intervention in Brussels, in front of journalists, he said that there is no evidence,” declared Călin Georgescu on Thursday, upon leaving the supreme court.

The trial at the ÎCCJ is scheduled for the Administrative Litigation Section. In this case, Călin Georgescu and the Coalition for the Defense of the Rule of Law sued several institutions of the Romanian state: the Central Electoral Bureau and several institutions (Ministry of Defense, Defense Staff, Government, General Prosecutor’s Office, Constitutional Court, Romanian Intelligence Service), but also President Klaus Iohannis and Elena Lasconi (USR). Georgescu is requesting the annulment of two decisions of the BEC ordering the resumption of the presidential elections from scratch, based on the decision of the Constitutional Court. On December 31, 2024, the Bucharest Court of Appeal rejected the action filed by Călin Georgescu, but he appealed to the ÎCCJ.

AUR: We keep on protesting

“The votes of over nine million Romanians were thrown away,” the AUR party accuses in a press release sent after Călin Georgescu definitively lost the case at the High Court demanding the annulment of the decision that established that the elections must be restarted from scratch.

“I cannot stop the voice of the people! We continue the protests for democracy! AUR President, George Simion, will be present today, starting at 8:00 p.m., in Victoriei Square, where he will protest for fair elections and for the vacancy of the position of president, illegitimately held by Klaus Iohannis, the author of the coup d’état in full swing,” the AUR press release states.

The party led by George Simion claims that attempts are now being made to “limit voting in the diaspora and censor the online environment”, referring to the Ordinance adopted by the Government regarding the date of the presidential elections in May.
“Today’s decision of the Supreme Court of Justice defies the millions of Romanians who are demanding a rerun of the second round. And it ignores the lack of clear evidence to annul the elections. But if they think they have seen their bags in the cart, they are sorely mistaken! Romanians have woken up! And they will continue to protest for a sovereign Romania, where decisions are made in the interest of the people,” the party also said. AUR says that the protests will continue on Saturday, January 18, from 2:00 PM, in front of prefectures in the country, but also in front of embassies in the diaspora.
Last Sunday, tens of thousands of people, according to AUR estimates as many as 100,000, participated in a rally organized by AUR against the annulment of the result of the first round of the presidential elections. The resumption of the second round with Călin Georgescu and Elena Lasconi and the resignation of President Klaus Iohannis were the main demands of the organizers.
