Mercenary Horațiu Potra escaped judicial control after the Prahova Court decided on Friday to lift the preventive measure. The court rejected the appeal of the Prosecutor’s Office attached to the Ploiești Court of Appeal, which had requested his preventive arrest. The ruling is final.
The Prahova Court admitted, on Friday afternoon, the appeal filed by Horaţiu Potra against the judicial control measure imposed on him by the decision of the Ploieşti Court. The court rejected the appeal of the Prosecutor’s Office attached to the Ploieşti Court of Appeal, which had requested his preventive arrest.
“Pursuant to art. 4251 para. (7) pt. 1 let. b) rel. to art. 202 Code of Criminal Procedure, rejects as unfounded the appeal filed by the Prosecutor’s Office attached to the Ploieşti Court against criminal conclusion no. 162 of 10.12.2024, pronounced by the judge of rights and freedoms within the Ploieşti Court. Pursuant to art. 4251 para. (7) pt. 2 let. a) rel. to art. 202 Code of Criminal Procedure, admits the appeals filed by the defendants Potra Horaţiu and Lup Andrei-Florin, against criminal conclusion no. 162 of 10.12.2024, pronounced by the judge of rights and freedoms of the Ploieşti Court, which it annuls in its entirety and re-judges: Pursuant to art. 227 paragraph. (1) Criminal Procedure Code, rejects as unfounded the proposal of the Prosecutor’s Office attached to the Ploieşti Court to take the measure of preventive arrest for a period of 30 days against the defendants Potra Horaţiu and Lup Andrei-Florin”, the court minutes write.
On Friday, the Prahova Court held hearings in the case in which prosecutors from the Prosecutor’s Office attached to the Ploieşti Court of Appeal challenged the Ploieşti Court’s decision to reject the proposal for preventive arrest on behalf of former mercenary Horaţiu Potra, suspected of public incitement, failure to comply with the weapons and ammunition regime and prohibited pyrotechnic operations.
Horaţiu Potra declared, on Friday, upon leaving the Prahova Tribunal headquarters, that he did not discuss with the former independent presidential candidate, Călin Georgescu, but with his “security guards”.
