Update – Another protocol revealed: Between the Prosecutor’s Office and Army’s intelligence service. MoD denounces the document

Another protocol was made public on Sunday evening by Antena 3 TV, a collaboration agreement between the Ministry of Defence (MoD) and the Prosecutor’s Office upon the High Court of Cassation and Justice (PICCJ). According to the source, the document was signed in 2011 by the head of the Army’s General Intelligence Directorate and by the PICCJ first deputy prosecutor.

According to the document, the protocol was reportedly approved by the Romanian Prosecutor General at the time, Laura Codruta Kovesi, and the then Defence Minister, Gabriel Oprea, the date of sealing the deal being April 4, 2011.

The quoted source states that it is a “protocol on the granting of mutual assistance for the fulfilment of legal duties and competences.”

The document allegedly was concluded for the purpose of “efficient use, according to the competences and attributions stipulated by the law, of the information regarding the national security in the defence field, as well as the prevention and combating of the crimes committed by the MoD staff.”

The document stipulates that in order to organize the coordination for the implementation of the Protocol, the following competent parties are established: for the MoD – the Army’s General Directorate for Intelligence, for the Prosecutor General’s Office – the Prosecutor General’s cabinet.

One of the protocol’s objectives is to “provide relevant and useful information and data for preventing, detecting and combating criminal offenses, as well as for efficient criminal prosecution, respectively the relevant and useful information and data for knowing and counteracting the vulnerabilities and internal and external threats to the national security in the defence field.”

At the same time, the quoted source mentions the existence of liaison persons acting jointly for the exercise of their competences.
