Simona Halep sues the company that produced the supplement allegedly contaminated with Roxadustat, asks USD 10 M in damages

Simona Halep has sued the Canadian company that produced the nutritional supplement that, in her opinion, led to her four-year suspension for doping. Halep is seeking more than $10 million in damages from Quantum Nutrition, which operates under the name Schinoussa Superfoods, after she tested positive at the 2022 US Open for Roxadustat, a drug often used by people with anemia, Reuters reports.

Roxadustat, which is on the World Anti-Doping Agency’s list of banned substances, can increase hemoglobin and red blood cell production, increasing endurance.

Halep, 32, said she used Schinoussa supplements during the 2022 Flushing Meadows tournament and that the Keto MCT she took was contaminated with Roxadustat, which was not disclosed on the label.

Simona stated that he has never used banned substances and that Quantum’s negligence and false claims that his supplement was legal damaged his career and caused him humiliation. Halep is also seeking punitive damages. She filed the lawsuit in a New York court in Manhattan.

Quantum, based in Scarborough, Ont., did not immediately respond to a Reuters request for comment. However, its founder told Canadian newspaper The Globe and Mail in October that Halep was looking for a scapegoat and that his company had been turned into a “scapegoat.”

Halep is contesting the four-year suspension imposed last September by a tribunal of the International Tennis Integrity Agency. Although it agreed that Halep did not know that the supplement could have contained Roxadustat, the tribunal said that this contamination could not have explained the amount of the drug found in her urine sample from August 29, 2022.

At the Court of Arbitration for Sport in The hearings in the Halep case took place in Lausanne last week. “I really believe that the truth will come out and that the day I will be on court will be soon,” Halep told reporters.
