Bill after the family referendum: People in civil partnerships will not be able to adopt children

PSD deputy Florin Manole has initiated a draft law on the civil partnership, intended to regulate the family life of the same-sex couples or of the people who are not married.

The draft though says that the people in civil partnerships will not be able to adopt children. The civil partnership is officiated at the city hall.

The draft comes following the ECHR case law, and is related to the family life. It has provisions referring to property issues, to debts, inheritances, etc. The Coman-Hamilton recent case is important in this discussion for it proved what means the legal protection of these type of people in the national legislation. The bill is explicitly banning adoptions,” said the initiator.

Asked how this civil partnership could be broken, he replied: „There are many possibilities. An option would be a settlement between parties or it can be denounced by one party, these are technical matters”.

According to Manole, the draft will be tabled in Parliament next week, following a request initiated by the National Council for Combating Discrimination.

He mentioned the civil partnership will not influence the definition of marriage and that UDMR will come up with proposals for the final draft of the bill.

Minister for European Affairs, Victor Negrescu has announced on Monday, one day after the failed referendum to redefine family, that MPs from all political parties will file a draft law on the civil partnership next week.
