ArcelorMittal has won lawsuit against ANAF on transfer pricing

High Court of Cassation and Justice has ruled in favor of ArcelorMittal in a lawsuit against the National Agency for Fiscal Administration (ANAF), a press release informs on Tuesday, this being the first national landmark decision in transfer pricing.

On June 30, 2016, the lawyers team of Radu and Associates SPRL (EY’s correspondent law firm), together with tax consultants within the Transfer Pricing department of EY Romania, won for one of the ArcelorMittal group companies cancellation of fiscal administrative acts issued by the inspection body with the consequence of canceling the tax loss diminishing, which amounts of RON 5.675 million.

The judges maintained a previous ruling in relation to reconsider the price level for transactions with ArcelorMittal’s related parties.

The success achieved by the practice of tax disputes and the one of transfer pricing within EY Romania is more important, the more legal issues, subject to judgment, is characterized by slicing for the first time, according to OECD Guidelines on transfer pricing and in accordance with the guidelines of relevant national legislation.
