Competition Council carried out unannounced inspections at Policolor, BASF

The Competition Council had opened an investigation on car paint market in Romania, on possible infringement of competition law, a press release informs.
The investigation concerns possible anticompetitive practices consisting in the conclusion of an exclusive distribution agreement between two competitors, Policolor and BASF Coatings Services Austria, as well as the concerted refusal of the two to supply products to a customer.
During the investigation, unannounced inspections were carried out at Policolor and BASF Romania headquarters, and the seized documents are analyzed by the Romanian competition authority according to the specific investigation procedures.
Unannounced inspections are authorized by the Bucharest Court of Appeal and are justified by the need to obtain all the information and documents necessary to clarify the possible anticompetitive practices analyzed.
The unannounced inspections represent a preliminary step within the investigation procedures on a possible anticompetitive behavior. Performing these inspections does not represent a prior decision of the Competition Council as concerns the final result of the investigation triggered.
