Hidroelectrica won the case against ANRE. The company can export electricity to Hungary

State-controlled hydropower producer Hidroelectrica won the lawsuit against Romania’s Energy Regulatory Authority (ANRE), a press release informs on Wednesday, which banned the export of electricity and fined the manufacturer for sale of electricity in Hungary during December 2014 – February 2015 period.

More precisely, Hidroelectrica has sold energy on a centralized, transparent and competitive platform in Hungary run by Tradition Financial Services Ltd., a global leader in the brokerage of energy products, although the company was obliged to sell all the energy produced on OPCOM platform in Romania, the quoted document reads.

According to Euro Insol, the insolvency administrator of Hidroelectrica, the interpretation given by ANRE violates the principle of free movement of goods within the Union.

“The court decision has historical value. At the time the sentence becomes final, any manufacturer, whether it is called Hidroelectrica, Nuclearelectrica or Oltenia will be able to conclude directly export energy contracts on any of the markets of the EU Member States,” company’s trustee Remus Borza said.

According to him, Hidroelectrica has exported 15 MWh, but was fined and warned by ANRE with supply license withdrawal.

By this prohibition, the state companies were deprived in the past two years of several tens of millions of euros that have entered into the pockets of the same ‘smart guys’ by whose companies all Romania’s energy export is running.

In turn, ANRE will call on the court sentence which upheld Hidroelectrica’s complaint, Marius Vladu, Director Communication, Cooperation and Relation to Parliament of ANRE said for agerpres.ro.
