The judges of the High Court of Cassation and Justice (ICCJ – Supreme Court) have released the reasoning for sentencing PSD Chairman Liviu Dragnea to 3 years and 6 months imprisonment, in the employment file at DGASPC Teleorman. The reasoning reads that he had an unlawful, antisocial and immoral conduct, in disagreement with the rank of public dignity – Chairman of the Teleorman County Council, hotnews.ro reports.
“The defendant Dragnea Nicolae Liviu, by instigating the defendant Alesu Floarea to violate her duties in the sense of maintaining in office the two employees, Botorogeanu Adriana and Stoica Anisa Niculina, knowing that they are not present at work and are violating their duties provided in the individual labour contract and in the job description, has adopted an unlawful, antisocial and immoral behavior, in disagreement with the rank of public dignity held, the degree of representation and the trust provided by citizens in the electoral process, leading to a violation of the prestige of the exerted function and of the good development of the social relations within the public institutions,” reads the reasoning of the ICCJ judges for the sentencing decision to 3 years and 6 months in prison for Liviu Dragnea.
Magistrates argue that the degree of social danger of the offenses is highlighted by “the way the officials in public institutions, in breach of their duties, agree to commit criminal offenses under different pretexts, being influenced and intimidated by how a County Council Chairman understands to exercise his authority, power and influence for illegal purposes.”
The Supreme Court sentenced Liviu Dragnea to 3 years and 6 months of imprisonment in the employment of the General Directorate for Social Assistance and Child Protection (DGASPC) Teleorman, in which he is charged with instigating to abuse in service. The ruling was made by two of the three judges of the panel. The third voted for the acquittal. The ruling is not final.
Liviu Dragnea has challenged the sentence ad the first court hearing of his appeal has been set for October 8, so the next day after the referendum to revise the Constitution. This time, Dragnea’ s file will be judge by a five-judge tribunal.
