Grindeanu cabinet, unfavourable position to Dragnea in ex-wife’s file

The government has adopted an unfavourable position to PSD leader Liviu Dragnea in a file that targets him, i.e. on the request made by Bombonica Prodana in the file she is investigated along with her ex-husband.

Bombonica Prodana urged the Supreme Court to notify the Constitutional Court on the admissibility of the lack of the threshold for the abuse of office she is accused of.

The government supports the Ministry of Justice’s response and opposes the admission of exception for Bombonica Prodana, realitatea.net informs.

It is about the file in which several people employed by the Teleorman County Social Assistance and Child Protection Directorate actually worked for the party (PSD) during the time when Liviu Dragnea was Chairman of the Teleorman County Council.

Asked to state whether the Government’s point of view on Bombonica Prodana’s objection of unconstitutionality, on the threshold of abuse of office, was drawn up by the Justice Ministry, Tudorel Toader (photo) replied affirmatively.

“Yes (it was drafted by the Ministry of Justice, our note) by our colleagues. I am not the one to conclude on the viewpoints. We have a directorate dealing with such issues,” the Justice Minister said.

“I believe you’re interested in something else. I answer the question you have not asked: there are two totally different hypotheses. One hypothesis was resolved by the Constitutional Court through decision 405. There is jurisprudence and, according to the law, article 29 of Law 47, reading that when a matter of law is resolved by the CCR by admitting the exception, whenever someone else comes and criticizes the same law from the same perspective, the exception becomes inadmissible,” Minister Tudorel Toader said.

“Therefore, by decision 405, the CCR accepted the objection of unconstitutionality in regard to the phrase <badly fulfils>. Whenever someone makes references to the 405, criticism is inadmissible,” the Justice Minister said.
