President challenges the first of the three justice laws to the Constitutional Court

President Klaus Iohannis has notified the Constitutional Court over the judicial organization law, the first of the three justice laws that have been adopted by the Parliament.

The President considers that the judicial organization law still contains unconstitutional provisions, so he notified the constitutional judges over 12 articles of the law.

Two days ago, Klaus Iohannis announced he would send all three justice laws to the Constitutional Court and that he would also notify the Venice Commission over them.

We cannot just watch passively the rewriting of the Constitution. The entire legal package has been adopted by the Parliament in one week and then no less than 4 months and 3 CCR decisions were necessary in order to amend it. All these prove that the result of parliamentary debates would have been better if the texts had been well founded and debated. I mean the Law 303/2004, Law 304/2004 and Law 317/2004,” Iohannis said on Wednesday.

The head of state argued that the amendments to the laws of justice are not meant to make it more effective, but to intimidate the magistrates and that the package of laws does not meet the exigencies of the rule of law and democracy, nor the Romanians’ expectations.
