President Klaus Iohannis has sent to the Constitutional Court of Romania (CCR) a notification of unconstitutionality on the normative bill for amending and completing the Local Public Administration Law no. 215/2001, the Presidential Administration has announced on Thursday.
The Head of State says that on December 23, 2017, the Parliament sent for promulgation the bill for the modification and completion of the Local Public Administration Law no. 215/2001, which establishes a new procedure regarding the validation, after the establishment of the local council, of local councillor mandates.
“This law establishes new rules regarding the quorum of the local council or of the county council meetings, as the case may be, in which it is proposed to validate or invalidate one or more local/county councillors. We consider this law to contain unclear regulations, imprecisely edited and breach article 1, paragraph (5), art. 16 para. (1), art. 120 para. (1), art. 121 para. (2) and art. 123 para. (2) and para. (4) of the Constitution,” the notification of unconstitutionality reads.
