President Klaus Iohannis has notified the Constitutional Court (CCR) about a bill adopted in December by Parliament, which provides that organizing referendums on the same day with European elections is banned.
The bill was sent to the head of state for promulgation on December 28, 2018, the Presidency informs in a release.
Some provisions are contrary to the constitution and the jurisprudence of the constitutional litigation court, President Klaus Iohannis argues in the referral to the CCR.
“The legislative authority is free to choose any legal solution in terms of referendums, without interfering with the competences of other public authorities in the field, and without amending the constitutional statute or the attributions provided by the fundamental law. However, the norm which bans organizing referendums on the same day with the elections for European Parliament affects constitutional norms and principles,” the referral addressed to the CCR reads.
