Prosecutor General’s Office: Protocols with SRI, signed on the basis of a Government Decision signed by Tariceanu

The Prosecutor General’s Office states that through a Government Decision adopted in 2005, when Calin Popescu Tariceanu was Prime Minister, it was decided to conclude protocols for establishing the procedures for communication with the Supreme Defence Council (CSAT), the Romanian Intelligence Service (SRI), the Foreign Intelligence Service (SIE) and other information structures.

Calin Popescu Tariceanu has been Prime Minister during December 2004-December 2008.

The Prosecutor’s Office upon the High Court of Cassation and Justice makes these explanations in order to clarify all aspects that led to concluding cooperation protocols between the Prosecutor’s Office and the SRI, the Public Ministry informs in a press release on Friday, ziare.com reports.

By Government Decision no. 231 dated March 30, 2005 regarding the “approval of the National Anticorruption Strategy 2005-2007 and the Action Plan for the Implementation of the National Anticorruption Strategy 2005-2007”, within the priority field II on “Combating Corruption” of the National Anticorruption Strategy, it was stipulated that “in order to increase the efficiency and effectiveness in the criminal prosecution activity, the effective and direct control of the prosecutor on the criminal investigation and investigation activities carried out by the judicial police will be strengthened. Procedures will also be put in place to allow the prosecutor to immediately notify the intelligence and investigative structures by transmitting any information and supporting evidence regarding the corruption offenses or organized crime.”

At the same time, Objective no. 9 of Priority field III: “Domestic cooperation and international cooperation” regulates the establishment of clear cooperation procedures between all the structures with attributions in the anti-corruption fight.

“The Action Plan for implementing the National Anticorruption Strategy unequivocally sets for the Prosecutor’s Office upon to the High Court of Cassation and Justice, for the National Anticorruption Directorate (former National Anticorruption Prosecutor’s Office), for the Ministry of Public Finance, for the Ministry of Justice, for the Ministry of Interior – to conclude protocols for the establishment of communication procedures with the Supreme Defence Council of the Country, with the Romanian Intelligence Service, with the Foreign Intelligence Service, with other information structures,” the Prosecutor General’s Office points out.

The press release draws attention to measure 4.5 – The prompt notification of the prosecutor who deals with corruption cases or organized crime, by the intelligence and investigation structures, by transmitting any information and supporting evidence regarding the corruption offenses or organized crime.

The Public Ministry has attached, for consultation, the Government Decision no. 231 dated March 30, 2005. It was signed by Calin Popescu Tariceanu (Prime Minister) and countersigned by Monica Macovei (Justice Minister), Vasile Blaga (Minister of Administration and Interior), Ene Dinga (Minister of European Integration) and Ionel Popescu (Minister of Public Finances).
