Senate Oks law on special pensions for local elected despite it has been declared unconstitutional

The law on special pensions for the local elected, that had been declared unconstitutional by the Romanian Constitutional Court, has been reexamined and voted by the Senate on Tuesday by 101 votes to one and six abstentions after a very short debate.

Early this year, the Constitutional Court of Romania ruled that the law on pensions for mayors, deputy mayors, chairmen and vice-chairmen of county councils is unconstitutional, admitting the government referral. Back then, the constitutional judges argued that the law didn’t stipulate the source of financing, while it is discriminatory at the same time among the categories of local elected, as simple local and county councilors are excepted.

According to the law adopted on December 22, 2015, the mayors, deputy mayors, presidents and vice-presidents of the County Councils who have the legal retirement age are entitled to a special pension at the end of their terms, the Senate decided. The plenum of the upper chamber passed the law on local representatives-elect by 86 votes to one, with the Liberal MPs leaving the hall before the vote.

The Senate is the decision making body in this case.

The National Liberal Party announced that it opposes the draft law, although said that it agreed the rise of the local elected incomes, yet arguing that the next government should deal with his issue.

On Tuesday, PNL co-chair Alina Gorghiu asked PM Dacian Ciolos to sack Cezar Radu Soare, secretary of state of the ministry led by Vasile Dincu, who had agreed with the draft law on special pensions for the local elected in the Senate, although the Government had opposed it.

Gorghiu made this request during the meeting that PM Ciolos had with the Liberal leaders, who expressed their discontent with the move of the secretary of state.
