President Iohannis signs decree to appoint Felix Banila as DIICOT chief prosecutor

President Klaus Iohannis has signed on Monday the decree to appoint Oliver-Felix Banila as chief prosecutor of the Directorate for Investigating Organized Crime and Terrorism (DIICOT).

The appointment is for a term of 3 years, the Presidency informs.

On June 5 the prosecutors’ section with the Superior Council of Magistracy (CSM) has given a positive opinion on the Justice Minister’s proposal to appoint Felix Banila as DIICOT chief prosecutor.

Felix Banila, 46, is prosecutor with the Prosecutor’s Office upon the Bacau Court. During 2010-2017 he was in the leadership team of the above mentioned institution. In 2016, Banila ran for a position with CSM to no avail.

On June 19, the DIICOT prosecutors decided, in the general assembly, to send a letter to President Klaus Iohannis to ask him not to appoint Felix Banila as the directorate’s chief. Judicial sources say the decision was made with 154 votes for and 47 against,

The DIICOT prosecutors said, in the request, that the project presented by Felix Danila shows he hasn’t had the proper documentation and does not understand the structure, competence and the directorate’s aims.

Felix Banila said he respects the prosecutors’ decision, but he has confidence in the ‘capacity’ of the President to decide according to arguments, by the law.

The DIICOT chief prosecutor is appointed by law by the Romanian President, upon the proposal of Justice Minister, with the positive opinion of CSM.
