Result of CCR decision: The appeals in files on Dragnea, Grebla and Ghita will be resumed from scratch

The draw for appointing the 5-judge panels of the High Court for 2018 will take place on Friday, the Supreme Court has announced, following the decision made on Wednesday by the Constitutional Court.

Actually, all court cases in appeal to the 5-judge panels will be resumed from zero, given the changed structure, ziare.com informs.

The High Court has two panels on the criminal issues, led by Vice-president Iulian Dragomir and the head of the Criminal Section, Mirela Popescu. According to the regulation set by CCR, the two will no longer be assigned from office in these panels.

The known files in the 5-judge panels have already had several hearings. They are to be resumed.

– Sebastian Ghita – on trial for bribe giving to the mayor of Ploiesti – 7 hearings during the appeal;

– Victor Mocanu, former PSD Deputy – 5 hearings during the appeal;

– Constantin Adascalitei, former PSD Deputy – 3 hearings during the appeal;

– Liviu Dragnea, Chamber of Deputies Speaker, PSD chairman – 2 hearings during the appeal;

– Toni Grebla, Government Secretary General – 2 hearings during the appeal.

The Constitutional Court ruled on Wednesday that there is a constitutional legal conflict between the Parliament and the High Court of Cassation and Justice (ICCJ – Supreme Court) on the issue of the establishment of the 5-judge panels. The decision was made by majority of votes.

The Constitutional Court thus admitted the referral from Prime Minister Viorica Dăncilă regarding a legal constitutional conflict between the Parliament and the ICCJ on the issue of the 5-judge panels.

CCR Chairman, Valer Dorneanu, explained, at the end of the hearings that the Supreme Court has issued several rulings since 2014, according to which only four members of the 5-judge panels were appointed by draw.
