CCR: Law on Administrative Code, providing for special pensions for the local elected, is unconstitutional

The Law on the Administrative Code – which provides special pensions for the local elected officials – is unconstitutional, the Constitutional Court has ruled on Tuesday, as CCR President Valeriu Dorneanu (photo) has told

The report on the unconstitutionality of this law was sent to the CCR by President Klaus Iohannis on July 31.

President Iohannis stated in the referral to the CCR that the law was adopted by the Chamber of Deputies in an unconstitutional extraordinary session, that the provisions on the obligation of the central public administration authorities and institutions and their staff to implement the governance programme approved by Parliament are unclear and criticized the fact that this normative act has removed a criterion of integrity for those who may be members of the Government – the one on incompatibility cases.

The law on the Administrative Code was referred to the CCR also by PNL, USR and PMP, who say that special pensions for local elected officials provided by the Administrative Code violate the principle of equality of citizens before the law.
