The Romanian Parliament has ignored the European legislation and has legislated contrary to a European Directive, in regard to the Criminal Procedure Code reading that the defender can take part to all prosecution steps or to any hearing, including of the victim, upon his request, the Constitutional Court (CCR) explains.
The reasoning refers to the controversial legal proposal that the defender could sit in front of the victim during the hearings. CCR has ruled this article as being unconstitutional.
CCR has issued on Wednesday the reasoning for decision 633 dated October 12, 2018, referin to the amendments to the Criminal Procedure Code. The document is 430 pages long. The reasoning includes two separate opinions from Judges Daniel Morar and Liviu Stanciu, ziare.com informs.
