Constitutional Court upholds the appeal filed by President Iohannis regarding the Statute of Civil Servants

The Constitutional Court of Romania (CCR) has uphold on Tuesday the appeal submitted by President Klaus Iohannis concerning the law on the Civil Servants’ Statute, which provides that civil servants should no longer be suspended if they are prosecuted for committing criminal offenses.

“We had an objection of unconstitutionality of the Law 188 on the Civil Servants’ Statute, an objection filed by the President, which we have uphold, and we have agreed that the repeal of the texts concerning the possibility of lawfully suspending the employment contracts of civil servants who are being prosecuted, has been unlawfully abrogated,” CCR President Valeriu Dorneanu (photo) said on Tuesday.

President Klaus Iohannis raised, on December 4, 2017, an objection of unconstitutionality of the Law amending and supplementing Law no. 188/1999 on the Civil Servants’ Statute, which provided that civil servants should no longer be suspended if they are being prosecuted for criminal offenses.

The head of state argued that the normative act reduces the standards of integrity and affects the citizens’ confidence in the institutions.
