Criminal complaint filed against Justice Minister Toader
The Federation of Trade Unions with the National Penitentiary Administration (FSANP) has announced on Tuesday that it has filed a criminal complaint to the Prosecutor General’s Office against Justice Minister Tudorel Toader, accusing him of alleged illegal decision regarding the payment of overtime hours for prison staff.
Tudorel Toader is accused of “illegitimate and abusive” decision for issuing on July 10, the Order 2721, which would cause monthly damages of about RON 1.2 million to the prison staff, despite the fact that the Federation warned him about this case, in writing and on the occasion of the debates organized by the Ministry of Justice.
The Federation states, by Article 13 (paragraph 2) of Order of the Minister of Justice 2721/C/10.07.2018, Tudorel Toader would illegally forbid the payment of more than half of the unrecovered overtime work on the pretext that an increase is paid for work during the weekly rest, although the law expressly states that these two rights apply separately, the legal situations for which they are granted are different
