CSM: Justice Minister’s request to dismiss Prosecutor General fails to meet legality conditions, ignores the CVM and Venice Commission recommendations
The Superior Council of Magistracy (CSM) prosecutors’ section has issued the reasoning for the negative opinion in the case of dismissing Prosecutor General, Augustin Lazar, upon the request of Justice Minister Tudorel Toader. It informs that the Cooperation and Verification Mechanism (CVM) report and the Venice Commission have recommended the immediate suspension of al procedures to appoint or revoke high ranking prosecutors.
The prosecutors’ section points to a Constitutional Court decision made in 2012, reading that all the CVM reports recommendations are compulsory for Romania, ziare.com reports.
The reasoning reads that the request filed by the Justice Minister “does not observe the legality conditions,” and an analysis on the solidity of reasons is not needed in regard to the ‘Report on the managing activity of Prosecutor General, Augustin Lazar.’
The negative opinion was issued on Monday with five votes ‘for’ and one vote ‘against’ (minister’s vote – our note). The Justice Minister said at the time that the dismissal procedure will go on, irrespective of the CSM opinion.
The CSM opinion is about 50 pages long.
