The Justice Ministry has completed the draft emergency ordinances on amending the Criminal Codes and on the retrial of sentences by the 5-judge panels with the High Court of Cassation and Justice (ICCJ – Supreme Court). The drafts have been sent on the notification circuit.
According to digi24.ro the final sentences ruled by the 5-judge panels with the ICCJ could be challenged in 60 days from the coming into force of the ordinance, although the deadline provided by the Criminal Procedure Code was exceeded.
The Justice Ministry’s draft provides the prolonging of the deadline and would allow all those who have been sentenced by such panels, during February 2014-Nivember 2018, to request in 60 days the retrial. The prescription has been suspended during the retrial.
Another draft by the Justice Ministry, sent to the Superior Council of Magistracy for discussions scheduled next week, refers to amendments to the Criminal Code and the Criminal Procedure Code. They were declared constitutional last year. Among the amendments – cuts in prescription deadlines for certain criminal offenses, changing of the conditions for release on parole and a one-year deadline to escape criminal liability for those who denounce criminal deeds.
