Justice Minister says he has made a decision on DNA’s Kovesi: “I’m going to formalize it”. Constitution should be amended
Justice Minister Tudorel Toader has announced on Friday he has made a decision regarding the Chief Prosecutor of the National Anticorruption Directorate (DNA), Laura Codruta Kovesi, based on the control conducted by the Judicial Inspection, and he is about to formalize it.
“I’ve made a decision. It’s a decision I’m about to formalize within my legal powers,” Toader said, asked about a possible dismissal of the DNA Chief Prosecutor, hotnews.ro informs.
Toader stressed that it’s not the Minister of Justice to revoke her from office.
“It’s not the Minister of Justice to revoke, he proposes the revocation, but the revocation is made by the President, you should ask him about this,” Toader said.
Asked if this year will be quiet in terms of justice, he said: “The quietness, we make it ourselves. Life has its dynamics – and social life, and your life, and my own, and of each and every one of us. The legal life has, in turn, another dynamic, we must all believe, hopefully, we are going on the right way.”
Following the checks conducted last year by the Judicial Inspectorate at the DNA, Justice Minister Tudorel Toader said he was the one to draw the conclusion on the report drawn up after the inspections, adding that, given that the views of the members of the control committee were divided, it is his role to ‘balance’ a final conclusion.
Constitution should be amended by introducing the principle of integrity
Asked if he agrees with President Klaus Iohannis on the introduction of the principle of integrity in the Constitution, Justice Minister Tudorel Toader has agreed that the Fundamental Law needs to be amended.
“Yes, the Constitution has to be amended, I have been a Constitutional Court judge for ten years, there have been numerous interpretative decisions by the CCR, decisions that have clarified certain provisions. Since the interpretation of the Constitutional Court partially clarified certain provisions of the Constitution, it means that on a review those decisions will be considered and the respective amendments will be imposed,” Tudorel Toader said.
Klaus Iohannis said on Friday at the CSM meeting that it is imperative that the principle of integrity is introduced into the Constitution so that people with criminal problems can no longer hold high positions in the state.
