Court of Appeal Judge Cancels CCR Decision on Election Cancellation

Judge Alexandru Vasile of the Ploieşti Court of Appeal decided on Thursday to annul and suspend the decision of the Constitutional Court (CCR) to cancel the presidential elections of December 2024. The decision can be appealed within five days of its pronouncement, the court’s portal states, and the appeal will be heard by the High Court of Justice and Cassation, which, on January 17, definitively rejected Călin Georgescu’s request to resume the presidential election round.

The decision by which the Ploiești Court of Appeal suspends and annuls the Constitutional Court’s decision to annul the presidential elections is “a gross mistake” and a “serious violation” of the Constitution, believes the former president of the Superior Council of Magistracy, Horațius Dumbravă.

“No court in Romania can annul a decision of the CCR,” declared PNL senator Daniel Fenechiu.

Former judge Cristi Dănileț stated that the decision of the Ploiești Court of Appeal is “a judicial aberration”, because “a court cannot suspend or annul a CCR decision”.

He also said, in a message on Facebook, that the judge risks a disciplinary investigation “for applying the law in bad faith” and that the solution will be corrected at the High Court of Cassation and Justice.

In an initial reaction after the Ploiești Court of Appeal decision, George Simion spoke about “returning to democracy and the rule of law.” “I support the return to democracy, to constitutional order and the rule of law: all of this means TURU2ÎNAPOI!” George Simion wrote on Facebook.

On December 6, 2024, the Constitutional Court annulled the results of the first round of the presidential elections, won by Călin Georgescu, based on declassified documents received by the CSAT from the SRI, SIE, MAI and STS. The SRI reports speak of an operation prepared in advance, in favor of Călin Georgescu, and which has the “mode of operation of a state actor”.

The Central Electoral Bureau (BEC) announced on Thursday evening that the electoral process for the presidential elections scheduled for May 4 continues.

“The activity of all offices continues on the basis of and for the execution of the measures provided for by the normative acts and administrative acts of a normative nature that target the current procedure for electing the President of Romania,” a BEC press release states.
