CSM notifies Judicial Inspectorate in the case of the investigation opened on EC First Vice-president Frans Timmermans
The Prosecutors’ Section of the Superior Council of Magistracy (CSM) has decided on Thursday to notify the Judicial Inspectorate in regard to the compliance with legal and regulatory provisions in the registration and settlement of the file on the complaint against Frans Timmermans, the First Vice-president of the European Commission.
The decision was made after the agenda had been supplemented.
In the CSM sitting, prosecutor Cristian Ban said that there are problems with the illegality of registering the file and the illegality of the solution. The prosecutor asked for checks on meeting the legal provisions.
This follows the decision made by prosecutor Adina Florea to open an investigation on Frans Timmermans, the First Vice-President of the European Commission, investigation for misconduct, intellectual forgery, false information and the formation of an organized criminal group.
Last week, the special section for investigating offenses in the judicial system has decided to close down the file targeting, among others, the First Vice=President of the European Commission Frans Timmermans.
“The prosecutors of the section for investigating offenses in the judicial system with the Prosecutor’s Office upon the High Court of Cassation and Justice have decided, on March 27, 2019, the close down the file named ‘Timmermans’ with charges of abuse of office, according to article 297 Criminal Code, intellectual forgery according to article 321 Criminal Code, communication of fake information according to article 367 Criminal Code, as no clue/indication of any kind has been found to lead to the reasonable assumption that the notified offenses have occurred,” a release sent by the institution informed.
Checks at the Special Section after the attempts to take over the Tel Drum- file
“I am concerned about the repeated request of the Special Section for Investigating Magistrates (SIIJ) to take over from the National Anticorruption Directorate (DNA), based on an anonymous denunciation, an ultra-mediatized file known by all that the Tel Drum file,” said prosecutor Cristian Ban during the CSM prosecutors’ section.
The members of the Section discussed the request made by the Prosecutor General, Augustin Lazar, on how Adina Florea (SIIJ) has tried four times to take over the Tel Drum-Liviu Dragnea file from DNA.
