JusMin: After criminal procedure code comes into force, anyone who feels he is convicted based on unlawful evidence can ask for judicial review

Justice Minister Tudorel Toader has stated on Tuesday that, after the amendments to the Criminal procedure code become operational, “any Romanian who feels he or she has been convicted based on unlawful evidence, such as taping or protocols, will be able to ask for the judicial review of the decision”.

The draft amending the Criminal Procedure Code has a new cause which stipulates the judicial review of the final decisions, if they have been ruled based on unlawful evidence, such as taping conducted by bodies which are not qualified to proceed with the criminal prosecution, like the Romanian Intelligence Service (SRI) or if they were managed based on protocols. It is not my work, it is the proposal coming from the special committee, it has been adopted, it is now at the Constitutional Court,” Tudorel Toader, told DC News.

The minister also announced that “not only the one who is in prison can ask for this review, but also the person who has a final decision of the court”.
