Pension Law – partly unconstitutional

The Constitutional Court (CCR) has discussed on Wednesday the referral from PNL and USR regarding the Pension Law and has ruled to return it to Parliament, declaring it partly unconstitutional.

The PNL and USR referral argued the unconstitutionality of the provision reading that the right to pension of an employee cannot be conditioned by the payment, by the employer, of the contributions for the employee. Thus, it opens the option to violate the employee’s constitutional right to pension, although this is a not a consequence of the employee’s failing to meet his obligations, the signatories said.

PNL and USR also claim the law provides unjustified discrimination between the disabled persons which are to benefit from pension, with a cut in the minimum contribution period only for one category of persons and not for all citizens with special needs, capital.ro informs.
