The Constanţa Court has dismissed on Monday the prosecutors’ appeal to the Medgidia Court against the release on parole of Mircea Băsescu (brother of former President Traian Basescu), who is to be released from the Poarta Albă penitentiary where he has been incarcerated.
The decision on Monday is final and enforceable, and he will be released from the penitentiary.
On September 4, the magistrates of the Constanţa Court postponed for a week the ruling on the appeal by the National Anticorruption Directorate (DNA), which opposed the release on parole decision.
Mircea Basescu was sued by the DNA – the Anti-Corruption Department in July 2014, and finally sentenced in June 2016 to four years in prison with execution.
On July 19, the Medgidia Court accepted the request filed by Mircea Basescu, for conditional release, a sentence that was challenged by the anticorruption prosecutors to the Constanţa Court. The July 19 request was the third conditional release filed by Mircea Basescu, in similar previous cases the decisions by Medgidia judges being attacked by DNA prosecutors who have won the case in the higher court.
Mircea Basescu executed one year of the four years of imprisonment for influence peddling in favour of the interloper Sandu Anghel, aka Bercea Mondial.
In June 2016, the judges of the Constanţa Court of Appeal sentenced Mircea Băsescu to 4 years in prison with execution, in a case involving Bercea Mondial’s family members.
Magistrates have also decided that Marian Capatana will execute the sentence in the same case of 3 years of detention for complicity in influence peddling.
The judges of the Constanţa Court of Appeals also ordered the seizure of EUR 265,000 from Marian Căpăţână, equivalent in RON at the BNR exchange rate on the date of the payment and the lifting of the seizure laid in 2014 on the movable and immovable assets of Mircea Băsescu, through the order of the Prosecutor’s Office upon the High Court of Cassation and Justice – the National Anticorruption Directorate – the Anti-Corruption Department.
At the same time, according to the Court of Appeals, the court removed “from the criminal sentence the provisions regarding the special confiscation of the amount of EUR 265,000, the equivalent in RON at the BNR exchange rate on the date of the payment, from defendant Basescu Mircea.”
Mircea Basescu’s lawyer, Nelu Tasca, claimed the defendant meets all criteria for release on parole, adding that he represents no risk to the society, digi24.ro informs.
In his turn, Mircea Basescu has told the court that he is facing health problems, he needs to buy medicine and that other people with longer sentences have already been released, their requests for release on parole being upheld. Mircea Basescu also said he would not be tempted to commit other corruption deeds if released.
