Mircea Sandu and Dumitru Dragomir, acquitted for decision to unaffiliate Universitatea Craiova football club. Decision is final

The Bucharest Court of Appeal has decided on Thursday to acquit the former president of the Romanian Football Federation (FRF) Mircea Sandu and the former president of the Professional Football League (LPF) Dumitru Dragomir in the file of the decision to unaffiliate Universitatea Craiova football club.

The two were acquitted for offenses of abuse of service, use of the influence or authority of the person in charge of management and for evading seizure.

The court also ordered the acquittal of both the Professional Football League (LPF) and the Romanian Football Federation (FRF).

The Bucharest Court of Appeal has admitted the appeals filed and has abolished the decision of the first court – the Bucharest Court in June 2016, by which Mircea Sandu and Dumitru Dragomir were sentenced to three years imprisonment on probation.

The court left unresolved the civil aspect of the file, SC Football Club Universitatea Craiova SA having the possibility to open a lawsuit in civil courts. In this respect, the judges maintained the seizure on the assets of Mircea Sandu and Dumitru Dragomir, but also of the LPF and FRF.

By this decision, the Bucharest Court of Appeal practically abolished the court’s decision by which Mircea Sandu and Dumitru Dragomir had to pay jointly with LPF and FRF the sum of EUR 240 million to SC Football Club Universitatea Craiova.

Mircea Sandu and Dumitru Dragomir were sentenced on June 13, 2016 by the Bucharest Court, to three years on probation in the file of unaffiliating Universitatea Craiova football club and to pay damages of over RON 1 billion.

The court’s decision was not final, Sandu and Dragomir having the right to appeal.

The National Anticorruption Directorate (DNA) prosecutors had demanded the maximum sentence – 10 years – for the two former heads of the Romanian Football Federation (FRF) and of the Professional Football League (LPF). However, Sandu and Dragomir, along with the two bodies they have led – FRF and LPF – will be forced to pay damages worth RON 1 billion to Adrian Mititelu, former owner of Universitatea Craiova.

FRF and LPF have received criminal fines of RON 370,000 each.

On June 17, 2013 the former FRF president Mircea Sandu and the former LPF head Dumitru Dragomir were indicted by the anti-corruption prosecutors in the file of the decision to unaffiliate Universitatea Craiova football club. Sandu and Dragomir were charged with abuse of office against the interests of persons, use of influence or authority in order to obtain for himself or for somebody else money, goods or unfair advantage and the offense of evading seizure.

In the same file FRF and LPF were indicted for abuse of office against the interests of persons and offense of evading seizure.
