NGO sues Justice Ministry to submit justice laws on public debate

The Alliance to Combat Abuse Association has announced that it sued the Ministry of Justice to compel it to submit to the public consultation/debate the draft amendment bill to the laws of justice, the ‘Tudorel Toade’ version.

The two appeals, namely the substantiation action and the request for a presidential order, were filed to the Brasov Court of Appeal, the Administrative and Fiscal Directorate, on September 25, 2017, and were communicated to the Ministry of Justice, which has already formulated a reply, according to a press release from the NGO on Wednesday.

“Our legal approach was determined by the obvious abusive conduct of the Justice Minister, who refused in the most arbitrary manner to submit to the public consultation/debate a normative draft containing numerous proposals of absolute novelty and with a major impact on the functioning of justice, under the implicit pretext and aberrant that this draft had undergone extensive public consultations in October 2016, during the mandate of Justice Minister Raluca Pruna, when the draft bill contained entirely other proposals advanced by the Ministry of Justice,” the Alliance to Combat Abuse Association informs.

The Association has also appealed to the Romanian Parliament not to discuss the draft bill on justice until this draft is subject to real public consultation/debate and/or until the Administrative Contentious Court has ruled on the legality of the Justice Ministry’s decision.
