Following her decision to give a positive opinion on the justice laws and stirring controversies, the chairwoman of the High Court of Cassation and Justice (ICCJ – Supreme Court) Cristina Tarcea has said, in an interview with Realitatea TV, she asks the prime minister not to green light the current draft on amending the justice laws supported by Justice Minister Tudorel Toader.
The reaction comes soon after Toader’s statements that the draft is non-negotiable, regardless of the negative opinion from the Superior Council of Magistracy (CSM).
“If the CSM vote would be resumed and I’d have the recent statement by Justice Minister, I believe my vote should be very thoroughly analysed, as the majority, almost unanimity counts, there are 4-6 very concerning issues that mark regress and puts in doubts the justice independence,” Cristina Tarcea said.
“I wish the Government passes the dialogue test and, from my points of view, this means to resend the draft to the Justice Ministry for dialogue in all aspects. Here are good things, but we cannot accept the issues that turn us back in time,” the ICCJ chair said.
She added her time as judge is more than 27 years, out of the 32 years in the justice system. “Never have I received a phone call to tell me what solution to choose in a file,” Tarcea said.
