Update 2: CSM to notify Judicial Inspectorate, after released recordings. DNA’s Kovesi denies alleged discussions about minister. PM Dancila to summon Justice Minister

Chief Prosecutor of the National Anticorruption Directorate (DNA), Laura Codruta Kovesi (photo 1), said on Monday that there was no discussion with any DNA prosecutor or with  about a file on a minister who could have become prime minister.

“There has been no discussion with any DNA prosecutor or the defendant Mihaiela Moraru Iorga (photo 2) about a file regarding any minister who could have become prime minister. I have never made any pressure or acts of interference in the activity of any prosecutor. I do not comment the unrealistic allegations of defendants,” Kovesi said.

The remarks come after former DNA prosecutor Mihaiela Moraru Iorga told on Sunday Antena 3 TV, that the DNA chief had summoned her and asked her if she could speed up the file of a former minister whose name was rumoured for the post of prime minister.

“At the time the Prime Minister of Romania was to be appointed. The name of a former minister was rumoured. I had a file on this former minister. I do not give names, because I do not want anyone to say I damaged an investigation. I was summoned and asked if we could speed up the file. The reason was that if this gentleman becomes prime minister, Mrs. Dana Girbovan will become Minister of Justice, which would mean a disaster for us,” Mihaiela Moraru Iorga said.

On the other hand, DNA has rejected the charges brought against it by former Deputy Vlad Cosma, who said the institution is ‘making’ files and presented recordings with talks he allegedly had with prosecutors Mircea Negulescu and Lucian Onea at DNA Ploiesti. Vlad Cosma showed to Antena 3 TV recordings with the two prosecutors trying to invent files based on ‘fabricated’ evidence for politicians and businessmen, among them businessman Sebastian Ghita.

PM Dancila to talk to the Justice Minister

Prime Minister Viorica Dancila has said on Monday she would have a discussion with Justice Minister, Tudorel Toader, after the recordings revealed on Sunday by Vlad Cosma.viorica dancila 2

“I will talk to the Justice Minister. I had no comments until now, but the situation becomes concerning for every Romanian. I can’t say what measures I expect, I cannot anticipate. Nevertheless, looking at the recordings last night, on ‘making’ the legal evidence for the Prime Minister, this is not a comfortable situation,” PM Dancila said.

CSM to notify the Judicial Inspectorate

The Judicial Inspectorate has taken notice of the recordings released Sunday evenings at Antena 3 TV. On Monday, the Judicial Inspectorate leadership has decided to take action ex-officio, in order to conduct checks about disciplinary misconduct related to the recordings presented by former Deputy Vlad Cosma.

“The Judicial Inspectorate leadership has analysed the information released Sunday evening and has decided to take action ex-officio. The inspectors will conduct prior checks about disciplinary misconduct,” a release reads.

The self notification comes for the deeds revealed by Vlad Cosma, as regarding the ones made by Mihaiela Iorga there is already a notification.

On the other hand, the Superior Council of Magistracy (CSM) informs that it will notify the Judicial Inspectorate. “We will notify the Judicial Inspectorate. The public opinion has the right to find out the truth as soon as possible,” CSM member Simona Marcu has told Q Magazine.


Who is Mihaiela Moraru Iorga

Last week, the National Anticorruption Directorate informed that prosecutor Mihaiela Moraru Iorga is prosecuted for favouring the perpetrator and intellectual forgery in continuous form (four material acts).

Iorga was revoked from the DNA but resumed her post after a court decision. Iorga is to be suspended from the magistracy, sources say.

According to the DNA, during 2015-May 2017, upon the request of a defendant in a DIICOT file, Ploiesti territorial service, Prosecutor Moraru Iorga, in order to complicate the investigation and the defendant’s prosecution, with direct intent, helped him through several committal acts and omissions.

Moraru Iorga is reportedly involved in two resounding files.

She was the first case prosecutor in the Microsoft files. The Microsoft files have been instrumented by Mihaela Iorga, one of the prosecutors recalled from DNA last summer after the scandal of the DNA meeting recordings’ featuring DNA chief prosecutor Kovesi ordering prosecutors how to investigate some cases. Immediately after her recall, DNA announced that serious irregularities had been found in the files conducted by Mihaela Iorga, with the DNA chief prosecutor asking the Judicial Inspection to check if Iorga had observed the criminal procedure norms in this case.

She was also involved in one of the Omar Hayssam files. The file on the privatization of former Baneasa Semiconductor enterprise, where Omar Hayssam was investigated, has been closed down.
