The High Court of Cassation and Justice ( Romania’s Supreme Court) retorted on the numerous debates in the public space on the latest acquittals in high sounding files, saying that it’s important that confidence should be maintained in the judiciary system to prevent the impression that court orders can be influenced.
„Following recent information released in the public space, referring to criminal files that are pending before the High Court of Cassation and Justice, we provide the following clarifications: the High Court of Cassation and Justice reiterated the importance of observing the justice independence, as a premise of the rule of law and as a fundamental guarantee of a fair trial. Justice independence is no privilege of the judge, the responsibility imposed to him to allow him close a file exclusively according to the law and based on evidence, without external influences of any type. Guaranteeing the justice independence it’s essential that the citizens should keep confidence in the judiciary, while maintaining this confidence reclaims that no other authority should give the impression that court orders could be influenced in any way,” reads a press release by the Supreme Court.
The High Court also underlined that moderation of the public speech related on judiciary must be crucial, the more „in those related to files pending before courts, regardless of the legal stage”.
