Justice Minister Tudorel Toader has announced on Sunday evening that his ministry has prepared an emergency ordinance to acquit all those people that had been sentenced by “illegally constituted judge panels”.
“I have prepared a draft emergency ordinance to restore all those sentenced by the illegally constituted judge panels. We’ll bring actions for annulment against it and the legally constituted courts will judge the cases again, and if they are guilty they will pay“, the minister told Romania TV.
Asked when the ordinance is issues, he replied: “The GEO is ready. It is not me who decides the time. I just make a proposal, a solution, I made the draft, the Prime Minister will decide. I think as soon as possible.”
Toader said that an ordinance solution will most probably be chosen also in the case of the files built based on the secret protocols between the Public Ministry and the Romanian Intelligence Service (SRI), but the Constitutional Court’s reasoning is expected in this case.
On Monday, minister Toader came back with further explanations on the GEO, stating that it should be also against those who generated “this unpleasant event”, meaning to those who had set up the 5-judge panels of the High Court since 2014 up to the present day.
He added that, in case the GEO is issued to retry the trials, all rulings by the 5-judge panels will be revised, even those which referred to acquitals. The annulment action on the acquittals will be filed by the prosecutor.
USR: Dragnea escapes conviction in the Referendum file
Save Romania Union (USR) has retorted in a Facebook post that PSD chairman Liviu Dragnea will get away with the conviction in the Referendum file (that prevents him from being PM) through the ordinance announced by the Justice Minister.
“History is repeating itself! Minister Tudorel Toader’s emergency ordinance will practically invalidate all sentences pronounced by the 5-judge panels of the High Court since 2014. Dragnea is getting away with the conviction in the Referendum file. Next to him, all corrupt people convicted by the High Court of Cassation and Justice in the past 5 years. So, the new GEO is coming right two years after the GEO 13, which was adopted on January 31, 2017, we must get ready to take to the streets again. Mobilisation is needed to prove that Romania doesn’t want offenders at the helm of the state anymore,” reads the USR post.
PNL’s Orban: PSD-ALDE is governing for the convicted criminals
Chairman of the National Liberal Party (PNL), Ludovic Orban said the newly announced GEO has not constitutional ground, and “PSD-ALDE is governing for the convicted criminals, and also whose conviction is pending.
“It is clear that PSD-ALDE is governing for the convicted criminals and for those who are not convicted yet, in the attempt of helping them get away with the punishment. Such an ordinance is not constitutional. The CCR ruling is very clear. It practically leaves it up to the courts to determine the course of the ongoing trials, to decide which evidence is properly managed and which is not. By no means it creates a constitutional ground for such an ordinance. There is definitely no constitutional ground to issue such an ordinance and we’ll try by all means to oppose it,” Orban said.
