Update: Venice Commission delegation pays visit in regard to the Criminal Codes. President Iohannis says amendments favour politicians with criminal files

A delegation of the Venice Commission is paying a visit to Romania on Thursday and Friday, in regard to the amendments to the Criminal Code and the Criminal Procedure Code.

“A delegation of the Venice Commission will visit Romania in the framework of the preparation of an opinion concerning the recent amendments to the Criminal Code and the Criminal Procedure Code passed by the Romanian Parliament. The opinion was requested by the Parliamentary Assembly of the Council of Europe.

The delegation will have exchanges with the President of Romania, the Minister of Justice, the High Court of Cassation and Justice, the General Prosecutor’s Office, the National Anticorruption Directorate (DNA), the Directorate for Investigating Organized Crime and Terrorism (DIICOT), the Superior Council of Magistracy (CSM), Parliament representatives including the Special Parliamentary Committee for amending the laws of justice, associations of judges and prosecutors, and civil society organisations,” a release from the Venice Commission reads.

President Iohannis: The amendments to the Codes favour politicians with criminal files

President Klaus Iohannis has told the members of the Venice Commission on Thursday that the amendments to the criminal codes reduce predictability and unbalance the judiciary, one of the effects being to favour politicians with criminal files.

“President Klaus Iohannis has reiterated during the talks the main issues raised by the new form of criminal law, as voted by Parliament. In this context, the President of Romania pointed out that the amendments to the criminal codes reduce the predictability and unbalance the judicial system, one of the effects being the favoring of politicians with criminal files. President Klaus Iohannis has argued that it is unacceptable to destroy the legal coherence. Also, the President of Romania stressed that the amendments proposed by the current parliamentary majority risk compromising the efforts in recent years to consolidate the judiciary,” the Presidency press release reads.

The opinion of the Venice Commission was requested by the Parliamentary Assembly of the Council of Europe on June 28, the conclusions of the assessment will be made public on October 19, digi24.ro informs.

Besides the GRECO recommendations, this opinion intends to find the best possible solution to approach the problems generated by the draft amendments, in accordance to the European standards and to Romania’s European commitments, the Council of Europe stressed.

Among the most important amendments to the Criminal Code are the redefining of abuse of office and the repeal of negligence in office.

The opinion of the Venice Commission was requested by the Parliamentary Assembly of the Council of Europe on June 28, the conclusions of the assessment will be made public on October 19, digi24.ro informs.
