Transporters, ready to protest again. Emergency Ordinance in Official Gazette says nothing about capping the RCA level

The government will cap the motor third party liability insurance (RCA) tariffs on a 6-month period, at a level to be determined by the Financial Supervising Authority (ASF). This was the title of the press release sent by Dacian Ciolos cabinet on September 14, announcing that it approved an Emergency Ordinance in this regard. Without seeing the text of the normative act, some employers’ associations in transport have given up the protests staged countrywide. Others continued the protest on September 15 and left only after they agreed with ASF some estimates of target rates to be applied for six months, hotnews.ro reports.

Well, the emergency ordinance reads that ASF will determine in 30 days the level of premium rates (maximum) for categories of vehicles and then, for a period of 6 months, ASF will calculate quarterly a reference tariff, for guidance.

The controversial emergency ordinance for RCA capping was published by the Official Gazette on Monday evening and takes effect but, according to insurers, will be negative and more difficult to control and repair. The normative act approved by the Government had been published on September 14 or September 15 on the website of the Ministry of Finance, to calm down the transporters in view of the protests.

The main problem is the fact that both versions have no mention that prices will be capped or frozen for six months, as announced by the government and by the Competition Council.

The transporters, who protested last Thursday in front of the Government for hours, have had a delegation at the Financial Supervising Authority (ASF) headquarters for negotiations. Dissatisfied by the motor third party liability insurance (RCA) tariffs, they demanded ASF head Misu Negriţoiu’s resignation.

After the negotiations, the employers’ associations representatives have received promises that the RCA ceiling will be lowered from RON 22,000 to RON 7,500.

The transporters have announced that they have reached an agreement with the ASF regarding the capping of RCA tariffs.

The protesters began to leave Piata Victoriei by around 16.30h.

The transporters conditioned the protest postponement scheduled on September 15 on the emergency ordinance regarding the RCA.

Last Tuesday, the Senate adopted Tuesday the RCA law proposal and after two weeks is going to get the Chamber of Deputies’ vote.
