The High Court of Cassation and Justice (ICCJ – Supreme Court) 5-judge panel has rejected on Monday the appeal filed by the Judicial Inspectorate after the CSM Prosecutor’s Section rejected the inspectorate’s request to sanction former DNA chief prosecutor Laura Codruta Kovesi. The reason: she sent her counselor, who was judge, to check two territorial DNA structures.
“By majority, it rejects as unfounded the appeal of the Judicial Inspectorate against Decision No. 5 P dated June 13, 2018 issued by the Section Prosecutors of the Superior Council of Magistrates in file no 5/P/2018. Ruling is final,” reads the minute of the 5-judge panel.
The decision on Monday was made by majority, three judges were for rejection, two for admission.
The separate opinion made by Corina-Alina Corbu and Maria Hrudei was in the sense of admitting the appeal of the Judicial Inspectorate and of sanctioning Laura Codruta Kovesi by “warning.”
The former DNA chief prosecutor has received on Monday the ruling in another trial in which the Judicial Inspectorate challenged the rejection of another action by the CSM prosecutors on July 25, 2018. This is the file concerning Kovesi’s refusal to appear before the parliamentary committee investigating the presidential election in 2009. A second 5-judge panel has rejected the appeal filed by the Judicial Inspectorate in the case of the hearings in Parliament regarding the presidential election in 2009.
The 5-judge panel included the judges: Virginia Filipescu, Bianca Tandarescu, Beatrice Nestor, Valentina Vrabie and Daniel Severin.
