EC gives Romania two months deadline to reimburse the car tax

The European Commission urges Romania to comply with the European Union legislation on the reimbursement of vehicle registration taxes unduly collected in the next two months, according to a release on Thursday.

The Commission has decided today (Thursday) to send a reasoned opinion to Romania because it does not ensure the full and immediate reimbursement of the registration taxes for second hand vehicles purchased from other Member States.

Prior to this decision, the EU Court of Justice considered these charges to be in breach of EU rules and of Article 110 of the EU Treaty.

The Romanian rules on the restitution of taxes do not observe the principles of loyal cooperation, equivalence and effectiveness. If Romania does not take action in the next two months, the Commission may decide to refer the case to the EU Court of Justice, the EC representatives say.
